EU: EUROPEAN COMMISSION IMPROVES IP PROTECTION

The European Commission has recently initiated measures to protect intellectual property rights and encourage European Companies, particularly SMEs and start-ups to invest in innovation and creativity.
Purpose of the measures
· Easy and efficient action against Intellectual Property Breach.
· Facilitation of cross-border litigation, and tackle the importation of counterfeited and pirated goods.
· Encouragement of fair and balanced licensing negotiations relevant to reward companies for innovation while also permitting others to build on this technology to generate innovative products and services.
The measures…
· Step up the fight against counterfeiting and piracy by Deprivation of commercial-scale IP infringers revenue flows (“follow the money” by focusing on the “big fish”).
- Clarity for Standard Essential Patents by offering guidance for a balanced and efficient SEPs system to ensure that product manufacturers can access technologies under transparent and predictable licensing rules. At the same time, patent-holders are rewarded for their investments in R&D and standardization activities so that they are incentivized to offer their best technologies for inclusion in standards.
